Ms. Vipul Divya, the learned counsel for the appellant has referred to the following judgments to submit that acquittal of the accused is not founded on any reasonable ground appearing from the materials on records:
(i) Judgment of the Hon'ble Supreme Court in"State of Uttrakhand v. Darshan Singh" (2020)12 SCC 605,
(ii) Judgment of this Court in Cr. Appeal (DB) No.861 of 2013 title"Sushen Modak v. State of Jharkhand", and
(iii) Judgment of Gujarat High Court in Case No.R/Cr.A/1156/2009 title "Mavjibhai Ramjibhai Taviyad v. State of Gujarat".
2. Mr. Jai Shankar Tirpathi, the learned counsel for the respondent no.2 has referred to the judgment of the Hon'ble Supreme Court in "Kashibai & Ors. v. State of Karnataka" 2023 SCC OnLine SC 575 in support of the judgment of acquittal rendered in S.T Case No.222 of 2012.
