05/03.08.2023 Heard the learned counsel for the petitioner. By invoking jurisdiction under Article 227 of the Constitution, the petitioner being the decree holder of judgment and decree passed by the Civil Judge (Junior Division)-I, Dhanbad in Original Suit no. 262 of 2016, prays for a direction upon the executing court to execute the decree as early as possible without any delay.
Counsel for the petitioner submits that as per instruction received from his client no second appeal under Section 100 of the CPC has been filed before this Court by the judgment debtor.
From the record, I find that Execution Case No. 21 of 2020 has been filed which is pending. The judgment passed in O.S. No. 262 of 2016 was challenged in Civil Appeal No. 18 of 2020 which was dismissed.
Considering the said submission, I direct the executing court to dispose of the execution case preferably within a period of six months without giving unnecessary adjournment to the parties.
Accordingly, the instant petition stands disposed of.
