Order No.06 Dated- 26.04.2023 I.A. No.2840 of 2023 Learned counsel for the appellant submits that this interlocutory application has been filed with a prayer to ignore the defect no.2 which is to the effect that the appellant nos. 1 to 1(c) of the certified copy of the judgment of the lower appellate court are not party to the decree under appeal and the appellant no.1 in decree under appeal is not party in certified copy of the judgment of the of the lower appellate court. It is next submitted by the learned counsel for the appellant that in the decree under appeal, the description of the appellants have wrongly been mentioned but in the certified copy of the judgment, the same has correctly been mentioned. It is next submitted that since decree is prepared on the basis of the judgment and in the judgment, the description of the appellants is proper, hence the mistake in the description of the appellants in the decree under appeal be ignored.

Considering the aforesaid facts and circumstances of the case, the defect pointed out at serial no.2 is ignored.

This interlocutory application is disposed of accordingly.
