Relying upon the judgment passed by a coordinate Bench of

this Court on 29.06.2022 in W.P.(C) No. 7285 of 2019, M/s. D.M.

Minerals Private Limited Vs. Union of India & Ors., being the lead

case, we are inclined to Rule Nisi.

Mr. Anil Kumar, learned ASGI, accepts notice on behalf of

respondent no.1 and Mr. Jai Prakash, learned A.A.G.-IA accepts

notice on behalf of respondent nos. 2, 3 and 4.

Let counter affidavit be filed on behalf of the respondents within

six weeks.

Rejoinder to counter affidavit be filed within two weeks,

thereafter.

List this case on 27.07.2023.

In the interregnum, operation of letter no. 217 dated 17.03.2020

(Annexure-7), shall remain stayed, subject to depositing 25 % of the

amount by the petitioner, so demanded, under protest within a period

of two months.
