Heard the parties.
Learned counsel for the appellant submits that he will file supplementary affidavit mentioning therein that the appellant of this appeal, Suresh Mahto is the only surviving legal heir of the deceased- Banbihari Mahto and also prays for time to file separate interlocutory application with the prayer to condone the delay in filing this appeal. Learned counsel for the appellant also prays for time for filing of interlocutory application with a prayer for exempting the appellant from filing the original certified copy of the common judgment passed in Land Reference Case 08 of 1989 to 10 of 1989 and 01 of 1995 within three weeks.
List this appeal along with this interlocutory application after filing of the supplementary affidavit.
If the supplementary affidavit or a separate interlocutory application with prayer for condonation of delay or a separate interlocutory application for exempting the appellant from filing the original certified copy, is not filed within three weeks, this appeal shall stand dismissed without further reference to Bench.
