Learned counsel for the petitioner submits that the case of the petitioner
is fully covered with judgment passed by this Court in the case of "Kishor Kumar
Srivastava Vs. The State of Jharkhand & Anr." in W.P.(Cr.) No. 325 of
2021. He further submits that in view of Food Safety and Standard Act, 2006 the
F.I.R. is required to be filed by competent person however, in the present case F.I.R.
has been filed by police officer who is not competent to lodge F.I.R in view of above
Act.
Mr. Devesh Krishna, learned counsel for the State submits that he will
examine the aforesaid order and file counter-affidavit within three weeks after Durga
Puja vacation.
Let this matter appear on 25.01.2023.
Till the next date, no coercive step shall be taken against the petitioner in
connection with Ramgarh P.S. Case No. 185/2021 pending in the Court of learned
Chief Judicial Magistrate, Ramgarh.
