08 / 21.09.2022 I.A. No. 1830 of 2021 Heard the learned counsel for the appellants. This Interlocutory Application has been filed with a prayer to implead Mobashir Rahman @ Mobahir Rahaman and Modassir Siddique @ Md. Mudassir Siddique as respondents.

Learned counsel for the intervener petitioner submits that Md. Hafiz, Md. Shahid and Md. Sayeed who purchased the suit land from the widow and other legal representatives of Sk. Subrati; subsequent to such purchase, have gifted the suit property to the petitioners and handed over the possession of the same to the petitioners, hence, it is submitted that the petitioners are the bonafide donees of the suit property and hence, they be impleaded as.

The intervener petitioners undertake that they will not take any stand contrary to the stand taken by the appellants in the suit or in this appeal and they undertake to abide by the decision rendered in this Second Appeal.

Considering the aforesaid facts, the intervener petitioners being Mobashir Rahman @ Mobahir Rahaman and Modassir Siddique @ Md. Mudassir Siddique are impleaded as respondent nos. 10 and 11 with the condition that they will not be permitted to take any stand contrary to the stand taken by the appellants in the suit or in the appeal and they will abide by the judgment to be rendered in this Second Appeal.

The Registry is directed to carry out necessary correction in the cause title of the appeal memo.

This interlocutory application is disposed of accordingly.
