1. The present acquittal appeal has been filed against the impugned judgment dated 25.02.2021 passed by the learned Judicial Magistrate-1st Class, Jamshedpur in C/1 Case No.2620 of 2015 (T.R. No.358 of 2021) by which the respondent no.2 has been acquitted from the charges under Section 138 of N.I. Act.

2. In view of the order dated 16.08.2022 passed by this Court in Acquittal Appeal No.144 of 2019, learned counsel for the appellant seeks permission to withdraw the present appeal with a liberty to prefer an appeal before the appropriate forum.

3. Learned counsel for the State has no objection.

4. Permission is granted.

5. Accordingly, the present appeal stands dismissed as withdrawn with aforesaid liberty.

6. Pending I.A., if any, stands disposed of.
