1. The present acquittal appeal has been filed against the impugned judgment dated 02.03.2020 passed by the learned Judicial Magistrate-1st Class, Deoghar in P.C.R. Case No.94 of 2013 (T.R. No.500 of 2020) by which the accused person has been acquitted from the charges under Section 138 N.I. Act.

2. In view of the order dated 16.08.2022 passed by this Court in Acquittal Appeal No.144 of 2019, learned counsel for the appellant seeks permission to withdraw the present appeal with a liberty to prefer an appeal before the appropriate forum.

3. Learned counsel for the State has no objection.

4. Permission is granted.

5. Accordingly, the present appeal stands dismissed as withdrawn with aforesaid liberty.
