Singh, Advocate Mr. Shivam Singh, Advocate For the State : Ms. Pinky Tiwary, AC to AG 7/20.09.2022 Counsel for the petitioner admits that a similar writ application praying for similar relief has been dismissed by the Hon'ble Single Bench of this Court in W.P(S) No. 3610 of 2017. He submits that the Letters Patents Appeal being LPA No. 179 of 2021, challenging the aforesaid judgment was also dismissed.

Counsel for the State admits that aforesaid fact. He submits that this case is squarely covered by the judgment passed in the aforesaid writ application and the Letters Patent Appeal.

Counsel for the petitioner at this stage submits that parties are contemplating to file Special Leave Petition before the Hon'ble Supreme Court in that case.

Considering the aforesaid submission that the instant writ application is governed by the decision of LPA No. 179 of 2021 wherein the dismissal of the writ application being W.P(S) No. 3610 of 2017, is confirmed, I hold that the order passed in LPA No. 179 of 2021 will govern this case also. Thus, this writ application stands dismissed in terms of the judgment passed by this Court in W.P(S) No. 3610 of 2017 and affirmed by LP.A No. 179 of 2021. It is made clear that if any SLP is filed, final judgment of the said SLP will govern this case also.
