Mrs. Priya Shreshtha, the learned Special PP states that records of this case have been handed over to her recently.
Mr. Raja Ravi Shekhar Singh, the learned Amicus has submitted that (i) seizure witnesses did not support the prosecution (ii) ballistic expert was not examined during the trial (iii) investigating officer was also not examined during the trial and (iv) on the basis of police witnesses conviction has been recorded.
With reference to the judgment in "Gunwantlal v. The State of M.P." AIR 1972 SC 1756, the learned Amicus submits that there is no evidence on record to establish that the sanctioning authority has applied his mind to the facts of the case.
Post this matter on 14th October 2022 as the first case. The Registry shall provide a copy of the paper book to Mrs. Priya Shreshtha, the learned Special PP.
