Learned counsel, Ms. Twinkle Rani has submitted that arguing learned counsel for the petitioner is suffering from Pneumonia, as such, matter may be adjourned.
Learned counsel for the respondents-State, Mr. Ravi Prakash Mishra, AC to AG has submitted that counter-affidavit has already been filed taking stand that department has already blacklisted the petitioner earlier, as such, petitioner's tender paper cannot be evaluated.
Learned counsel for the respondents-State has further submitted that in view of recent judgment passed by the Apex Court in the case of N.G. Projects Limited vs. Vinod Kumar Jain and Others, reported in 2022 SCC OnLine SCC 336, petitioner's writ petition is not maintainable.
Considering such submissions, let the matter appears after Dussehra Holidays.
