Order No.09 Dated- 13/10/2022 Heard the learned senior counsel for the appellants. This appeal will be heard on the following substantial questions of law:-

(i) Whether the First Appellate Court committed an error of law by holding that the suit is not barred by Section 8 of The Ranchi District Tana Bhagat Raiyats' Agricultural Lands Restoration Act, 1947?

(ii) Whether the judgment and decree passed by the First Appellate Court is perverse having been passed by misinterpreting the provisions of The Ranchi District Tana Bhagat Raiyats' Agricultural Lands Restoration Act, 1947 and ignoring the documents and evidence in the record?

Issue notice to the respondents.

The appellants are directed to file requisites for service of notice upon the respondents by registered post with A/D as well as under ordinary process within six weeks failing which; this appeal shall stand dismissed without further reference to the Bench.

Rule is made returnable within six weeks. List this appeal after receipt of the service report of the notice upon the respondents.

In the meantime, call for the lower court records.
