04/18.11.2022 Mr. Apurva Singh, learned counsel for the State submits that the Department has filed Special Leave Petition against the judgment passed in the L.P.A. by this Court. He further submits that in the cause title of the instant case, the post held by O.P. No. 4 has been written wrongly as Deputy Commissioner in place of Divisional Commissioner.
2. Learned counsel for the petitioners is directed to make necessary correction with respect to O.P. No. 4 in the cause title during the course of the day.
3. It appears that the order passed by the writ court was challenged before the Division Bench of this court and the appeal was also dismissed way back in the month of March, 2022, i.e. on 07.03.2022. However, S.L.P. has been filed before the Apex Court on 31.10.2022 which clearly shows the delaying tactics on the part of the Opp. Party State.
4. Be that as it may, order of this court in the writ petition must be complied within seven days from today, failing which O.P. No. 4 shall remain personally present before this court to show cause as to why not a contempt proceeding be initiated against him for deliberately flouting the order of this court.
5. It goes without saying that compliance order to be passed by the Opp. Party State will be subject to the decision of the S.L.P.
6. Put up this case on 28.11.2022 at 4 p.m.
