06/16.11.2022 The reasoned order dated 07.04.2022 passed by the Senior Divisional Personnel Officer, Ranchi has been enclosed to the show cause filed on 11.11.2022. Learned counsel for the petitioner submits that the claim has been rejected though in an illegal manner without dealing with the observations made by this Court in the judgment dated 03.01.2022 passed in W.P.(S) No. 6636 of 2014.

Learned Additional Solicitor General of India submits that matter was remanded to the competent authority to take a decision in accordance with law after compliance of the principles of natural justice. This Court has not given any categorical finding on the merits of the claim made by the petitioner for protection of Grade Pay of Rs.2400/-.

Having regard to the aforesaid facts and that the reasoned order has been passed after the matter was remanded, no case of contempt is made out. However, petitioner is at liberty to assail the reasoned order in an appropriate proceeding.

Contempt petition is disposed of.
