08/30.03.2022 Heard the learned counsel for the appellant and learned counsel for the State.
By way of filing the interlocutory application, the appellant has renewed his prayer to suspend the sentence and release him on bail, during the pendency of this appeal.
Counsel for the appellant renews the prayer for bail on the ground that the appellant is in custody since 27.09.2014 and the awarded sentence is 14 years.
After hearing the counsel for the appellant, we have gone through the judgment. We find that the appellant has been convicted for committing offence under Section 6 of the POCSO Act. P.W.-2 is the minor girl, who was raped. She is aged about 8 years only. In her statement, she has completely supported the prosecution case and implicated this appellant as perpetrator of the crime.
Considering the aforesaid fact, we are not inclined to enlarge the appellant on bail after suspending the sentence. Accordingly, his prayer for bail is rejected.
The aforesaid interlocutory application stands dismissed. Liberty is reserved to the appellant to pray for early hearing of the appeal.
