6/23.03.2022 This interlocutory application has been filed under Section 5 of the Limitation Act, to condone the delay of 319 days, occurred in filing this appeal.
Counsel for the appellant submits that the appellant was injured and was suffering from several physical ailments and also was undergoing regular treatment after the accident. He submits that even after the judgment was passed he was undergoing regular treatment as he suffered brain injury. Counsel for the appellant relies upon the several medical documents annexed with this interlocutory application.
Learned counsel appearing for the respondents opposes the prayer.
After going through the records and medical documents, I find that the reasons have sufficiently been explained by the appellant for condoning the delay of 319 days, occurred in filing this appeal as the appellant was undergoing treatment at Jamshedpur, New Delhi, Kolkata and Bengaluru. Accordingly, this interlocutory application is allowed. The delay of 319 days, occurred in filing this appeal is hereby condoned.
I.A. No. 8007of 2019 stands disposed of.
