06/30.06.2022. Mr. Sah, learned counsel for the petitioner submits that the company
has already went into liquidation in terms of the order passed by the
Hon'ble Calcutta High Court in CP No.84 of 2015. He further submits that so
far as liquidation aspect is concerned, the company is protected by the
judgment of the Hon'ble Supreme Court in the case of P. Mohanraj v.
M/s Shah Brothers Ispat Pvt. Ltd. , reported in (2021) 6 SCC 258. He
also submits that however he has instruction that the Directors are not
being protected and the petitioner is one of the Director. In that view of the
matter, he seeks time to take instruction with regard to liquidation
proceeding.
In spite of several opportunities provided and valid service of notice
upon opposite party no.2, he has not appeared as yet.
Let this matter appear on 12.09.2022.
Interim order dated 21.02.2018 shall remain in force, till the next
date.
