This interlocutory application has been filed with a prayer to condone the delay of 07 days in filing the present appeal. It is further submitted by the learned counsel for the appellants that the appellants after obtaining the certified copy of the impugned Judgment and Decree, due to financial constraint, could not contact their lawyer immediately which resulted in delay in filing the instant second appeal. It is next submitted that the appellants have very good grounds to agitate in this appeal and unless the delay in filing of the instant second appeal is condoned, the appellants will be highly prejudiced.
Learned counsel for the contesting respondents opposes the prayer for condonation of delay in filing the instant second appeal.
Considering the facts and circumstances of the case, the delay of 07 days in filing the instant second appeal is condoned.
This interlocutory application is disposed of accordingly.
