07/09.06.2022 Learned counsel for the respondent, Mr M.B.Lal submits that arrears of maintenance awarded by learned Family Court by impugned judgment has been paid to the respondent to the tune of Rs. 01 Lakh through Demand Draft as part payment on 12th November, 2021. Learned counsel for the respondent, however, submits that the respondent being widow is not able to file any execution case for realization of arrears of maintenance and current maintenance. She may be provided legal aid.
In the above circumstances, the Secretary, DLSA, Dhanbad shall make necessary enquiry from the respondent whether she is in need of legal aid being a lady covered within the definition of 'person' under Section 12(c) of the Legal Services Authorities Act, 1987. In case, she makes such an application, the same be considered in accordance with law. Registry to intimate the necessary details of case number, name and address of the respondent to the Secretary, DLSA, Dhanbad for the purpose of undertaking such an enquiry.
Secretary, DLSA shall furnish a report to that effect within three weeks.
