09/07.06.2022 Reference may be made to the orders dated 19th April, 2022 and 4th May, 2022. Appellant-husband has approached this Court in the present appeal being aggrieved by dismissal of Original Suit No. 705 of 2018 vide judgment dated 7th February, 2020 passed by learned Principal Judge, Family Court, Jamshedpur. However, during mediation parties have agreed to settle their dispute amicably by seeking dissolution of marriage through mutual consent under Section 13(B) of Hindu Marriage Act, 1955.

Learned counsel for the parties inform that the suit for dissolution of marriage through mutual consent has been filed on 27 th May, 2022 being Original Suit No. 400 of 2022. The next date is on 9th June, 2022. Parties are complying with other terms of settlement also in the meantime. Learned counsel for the parties submit that the instant appeal can be disposed of in terms of settlement.

In that view of the matter, the instant appeal is disposed of in terms of the settlement as the parties have already preferred suit for dissolution of marriage through mutual consent under Section 13(B) of Hindu Marriage Act, 1955 before learned Family Court, Jamshedpur.
