Learned counsel for the parties is present. Learned counsel for the O.P. No. 2 has submitted that he has not in contact with the O.P. No. 2 despite several efforts and with respect to that a counter affidavit has been filed.
The office is directed to issue notice to the complainant. Let the notice be served upon the O.P. No. 2 through the concerned police station and submit the report.
Learned A.P.P. is directed to take steps definitely by contacting the concerned police station in order to ensure the presence of the informant /complainant positively by the next date.
Learned counsel appearing on behalf of the petitioner submits that the status report called for has been received from the concerned court and from the perusal of the status report, it appears that the accused Allauddin Ansari the accused no. 1 has been acquitted by the learned trial court vide judgment dated 17.03.2020 and he was the main culprit and this petitioner has no role to play in the commission of the offence as alleged in the complaint.
Let this case be listed after twelve weeks.
