Learned counsel appearing for the petitioner submitted that the petitioner B.N. Roy @ Birendra Nath Roy has died and further it is submitted that this case relates to Kotwali P.S. Case No.595 of 2007, corresponding to G.R. No.3176 of 2006, pending the concerned court below, has been disposed of with respect to this petitioner, under which, he has been acquitted vide judgment dated 2.12.2019 and therefore it is submitted that this Cr.M.P. No.1278 of 2008 has become infructuous.
Leaned counsel for the O.P. No.2 is present and he has also not controverted the fact about the disposal of this case pending in the court below.
Having taken into consideration, the aforesaid fact, this Cr.M.P. is disposed of.
