Learned A.P.P. appearing on behalf of the State submits that in Nimiaghat P.S. Case No. 123 of 2009, process under Section 83 Cr. P.C. has already been issued. Thus, in view of the judgment passed by Hon'ble Supreme Court, this anticipatory bail application is not maintainable.
Considering the fact that process under Section 83 Cr.P.C. has been issued and the same has been recorded way back in the order dated 10.12.2021 and thereafter four weeks' time was granted and thereafter, again time was granted on 21.01.2022 and now the case has been listed today.
Considering the submission of the A.P.P., I am of the opinion that this anticipatory bail application is not maintainable. Accordingly, the same is hereby dismissed as not maintainable.
