Mr. Arun Kumar, the learned counsel for the petitioner has brought to the notice of this Court a decision by the Division Bench of this Court in "Deepak Modak v. State of Jharkhand" (2021) 4 JBCJ 474.
Mr. Mahesh Tewari, the learned counsel for Opposite Party Nos. 2 to 6 however with reference to paragraph no. 11 of the judgment in "Gangula Ashok and another v. State of Andhra Pradesh" (2000) 2 SCC 504 submits that no complaint as regards offence under any special act can be filed straightway in the Court of Sessions, which has been done in the present case and, therefore, the order under challenge does not require any interference by this Court.
A question as regards judicial discipline and propriety may require to be addressed by the Court. The learned counsels appearing for the parties shall make their submissions on the next date of hearing.
