5/11.02.2022 This petition has been heard through Video Conferencing in
view of the guidelines of the High Court taking into account the situation
arising due to COVID-19 pandemic. None of the parties have complained
about any technical snag of audio-video and with their consent this
matter has been heard.
The learned counsel for the petitioner submits that report of
Govt. Analysis was prepared on 14.11.2005. He submits that the date has
been changed to 20.02.2006. He submits that this case is fully covered
under the judgment of this Court passed in Cr.M.P.no.3188 of 2017 dated
20.10.2021. He further submits that the analysis report was not supplied
to the petitioner which is mandatory provision under section 25 (3) of the
Drugs and Cosmetics Act.
The State is directed to file counter affidavit within six
weeks.
In the meantime there shall be stay of further proceeding in
connection with Complaint Case No.CIII 184/14 pending in the court of
learned AJC II, Ranchi till next date.
