04/ 09.02.2022 This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.
Learned counsel appearing for the petitioners shall array the informant as O.P. No. 2 in this case.
Learned counsel appearing for the petitioners submits that on the basis of evidences of three prosecution witnesses, the main accused has already been acquitted, vide judgment dated 21.12.2021 passed in G.R. No. 1251 of 2011 and the Trial Court after considering the evidences of three witnesses has come to the conclusion that these petitioners are required to be summoned under Section 319 Cr.P.C.
Let notice be issued upon the newly added O.P. No. 2 under registered cover with A/D as well as by ordinary process, for which, requisites etc. must be filed within two weeks.
Learned counsel appearing for the State shall also take instructions in the matter and file counter affidavit within four weeks.
Let this matter appear on 30.03.2022.
