Mr. Mahavir Pd. Sinha, the learned counsel appearing for the private respondents in WP(S) No. 1186 of 2017 has concluded his arguments.
Mr. Mahavir Pd. Sinha, the learned counsel has referred to the
judgments in "Ashok Kumar and Anr. v. State of Bihar and Ors." (2017) 4 SCC 357, "Ramesh Kumar v. High Court of Delhi and Anr." (2010) 3 SCC 104, "Jasvinder Singh and Ors. v. State of J&K and Ors." (2003) 2 SCC 132, "Union of India and Ors. v. S. Vinodh Kumar and Ors." (2007) 8 SCC 100, "M.V. Thimmaiah and Ors. v. Union Public Service Commission and Ors." (2008) 2 SCC 119, "Barun Kumar & Ors. v. State of Jharkhand & Ors." in Civil Appeal No. 5812 of 2022 and "Anmol Kumar Tiwari & Ors. v. The State of Jharkhand & Ors." in Civil Appeal Nos. 429-430 of 2021 to submit that if the selection process was impartial and non-discriminatory, the final result should not be interfered in exercise of the powers under Article 226 of the Constitution of India.
Mr. Sanjay Kumar Tiwari, the learned SC-I, however, seeks adjournment for apprising the Court whether there are vacancies against which the writ petitioners if they are successful in the present proceeding can be adjusted, of course, on merits.
On his request, for filing an affidavit in this regard, post these matters on 20th January 2023.
