09/06.12.2022 Learned counsel for the State-AAG-II, Mr. Sachin Kumar is the lead counsel in this batch of writ petition concerning the same petitioner relating to different assessment years. He seeks time to obtain fresh instructions as the earlier counter affidavit was based upon the decision of this Court in the case of W.P.(T) No.6285/07 judgment dated 24.04.2008 on the pre-amended provision of Section 18(8)(ix) of JVAT Act, 2005 which was amended vide notification dated 7th May, 2011 with effect from 1st April, 2006.

Two weeks' time as prayed for is allowed to the learned counsel for the State to seek instruction and, if necessary, file fresh counter affidavit. Let the matter appear in the 2nd week of January, 2023. Petitioner, if so advised, may file reply in the meantime.
