4/23.08.2022 The learned counsel appearing for the petitioners submits
that the case is arising out of land dispute and unnecessarily the SC/ST
Act has been added in the F.I.R whereas no ingredient is made out. He
submits that the case of the petitioner is covered under the judgment
rendered in the case of Hitesh Verma v. State of Uttarakhand, (2020) 10 SCC
710.
Let notice be issued upon the O.P.No.2 by registered post
with A/d as well as under ordinary process for which requisites etc. must
be filed within two weeks.
In the meantime, no coercive steps shall be taken against
the petitioners in connection with SC/ST Case No.07/2018, corresponding
to G.R. No.415 of 2007, pending in the court of learned Additional
Sessions Judge-I, Chatra, till the next date.
Let it appear on 10.11.2022.
