10/ 05.08.2022 Mr. Arun Kumar Pandey, learned counsel for the petitioner submits that in the instant case the only question which is to be decided by this Court is whether the T.I. parade which was conducted after a gap of two months will be admissible in the background that during the period of two months the petitioner was brought to the Court several times when he was in judicial remand; as such there was ample opportunity for the victim to identify the accused. He further submits that there are catena of judgments wherein it has been held that the T.I. parade is meaningless if the same is not done within a short period. He prays and allowed two weeks' time to produce the Rulings in support of the aforesaid contention.
2. Mr. Shravan Kumar, learned counsel appearing for opposite party No.2 opposed the prayer for acquittal and submits that two Courts meticulously examined the depositions and came to the conclusion that the petitioner is accused for the charge of under Section 392 of the Indian Penal Code, as such no interference is required.
3. Be that as it may, put up this case on 18.08.2022 for further hearing.
