2/ 27.04.2022 It has been argued by learned counsel for the petitioner that punishment order of Censure has been passed in utter violation of the principles of natural justice. Placing heaving reliance on the judgment of the Hon'ble Apex Court rendered in the case of O.K. Bhardwaj Vs. Union of India & Ors. reported in (2001) 9 SCC 180, it has been argued that the impugned order has been issued in teeth of Rule 19 of the Jharkhand Government Servants (Classification, Control & Appeal) Rules, 2016 and the same is not tenable in the eyes of law.

Since no counter affidavit has been filed, respondents are directed to file the same within three weeks.
