07 / 26.04.2022 Heard learned counsel for the appellant and the State on the prayer for condonation of delay of 249 days in preferring this Memo of Appeal made through I.A. No. 992/2022.
2. Learned counsel for the appellant submits that appeal was filed within time, but inadvertently, certified copy of the impugned judgment could not be annexed to the Memo of Appeal. There is no deliberate laches on the part of the appellant. He would suffer irreparably if delay is not condoned since he has a good case on merits.
3. Learned counsel for the State has opposed the prayer.
4. On consideration of the explanation and the submission of the parties, we are inclined to condone the delay. I.A. No. 992/2022 is allowed.
