Oral Order 04/Dated: 25.04.2022
The explanation given by the Office is outrightly rejected
because it has been submitted without considering the order passed by
the Hon'ble Supreme Court in Miscellaneous Application No.21 of
2022 and other matters in a Suo Motu Writ Petition (C) No.03 of 2020.
The Hon'ble Supreme Court has clearly stated in paragraph 5(III) that
the cases where the limitation would have expired during the period
15.03.2020 till 28.02.2022, notwithstanding the actual balance period of
limitation remaining, all persons shall have a limitation period of 90
days from 01.03.2022. In the present case, the impugned order has been
passed on 18th August, 2021 and the present appeal has been preferred
on 29th October, 2021.
Accordingly, let a fresh stamp report regarding limitation be
made after perusal of the aforesaid judgment of the Hon'ble Supreme
Court.
Put up this case on 27.04.2022.
