It is jointly submitted at the Bar that the main issue involved in

this case is covered by the decision rendered in the case of M/s.

Ramkrishna Forgings Limited, Kolkata Versus The State of Jharkhand

and others passed in W.P.(T) No.134 of 2016 and its analogous cases,

save and except the prayer no.1(v) of the instant writ petition.

Learned counsel for the petitioner submits that the writ petition

may be disposed of in terms of the aforesaid judgment with a liberty to

press prayer no.1(v) filed in a different set of proceedings as this issue

was not pressed before the Division Bench in the aforesaid matter.

In the result, the writ petition is disposed of with the aforesaid

liberty.
