07/ 19.04.2022 It has been submitted by learned counsel for the petitioner that after rendering 35 years of service, the petitioner's services have been put to an end on the ground that the certificates submitted by the petitioner was not a genuine one.

It is the specific case of the petitioner that without initiation of any regular departmental proceeding, the services of the petitioner has been put to an end. Relying on several judgments of this Court as well as the Hon'ble Apex Court and submits that the impugned order is not tenable in the eyes of law, merely by serving show-cause services of the petitioner cannot be put to an end.

However, from perusal of the impugned order at Annexure-18, it appears that Prapatra 'Ka' was served to the petitioner and departmental proceeding was initiated before passing of the impugned order.

The same is being denied by the petitioner.

Let the respondent-State file a specific affidavit stating therein as to whether regular departmental proceeding was ever initiated against the petitioner and also brought on record the entire documents pertaining to the departmental proceeding.

List this case after three weeks.
