09/13.04.2022 Heard the learned counsel for the appellant and learned

counsel for the State.

By way of filing this interlocutory application the appellant

has renewed his prayer to suspend the sentence and release him on bail,

during the pendency of this appeal.

Counsel for the appellant submits that two witnesses P.Ws.-

2 and 5, who are victims have not identified this appellant. He further

submits that the similarly situated co-convicts namely Randhir Paswan

and Mithilesh Paswan have already been granted the privilege of bail in

Criminal Appeal (DB) No. 525 of 2007.

We have gone through the judgment and order dated

27.01.2010, passed in Criminal Appeal (DB) No. 525 of 2007.

Considering the judgment, we find that the victims have not

identified this appellant and similarly situated co-convicts have already

been granted the privilege of bail by a co-ordinate Bench of this Court,

we are inclined to allow this interlocutory application. The Sentence

against the appellant, above named, is suspended and he is directed to

be released on bail, during the pendency of the appeal, on furnishing bail

bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount

each, to the satisfaction of the learned Sessions Judge, Latehar, in connection with S.T. No. 87-A of 2002 [arising out of Latehar P.S. Case

No. 115 of 2001], subject to condition that he will mark his attendance

once in every four months before the Registrar, Civil Court, Latehar, till

disposal of this appeal.

With the above observation, this interlocutory application is

allowed.
