09/12.04.2022 Mediation has remained a non-starter as per the report of the learned Mediator, JHALSA bearing letter no. 859 dated 21.03.2022 due to non-appearance of the appellant.
Learned counsel for the appellant Mr. Amrendra Kumar, on instructions, seeks permission to withdraw this appeal as the appellant husband is no longer interested in prosecuting the appeal. The appeal is directed against the judgment dated 11.12.2018 and decree dated 05.01.2019 passed in Matrimonial Suit (Divorce) No. 177 of 2013 by the court of learned Principal Judge, Family Court, Deoghar whereby the suit seeking dissolution of marriage under section 13(1) (i)(1-A)(i)(ii) of the Hindu Marriage Act, 1955 preferred by the petitioner/ appellant herein has been dismissed.
In view of the prayer made by the learned counsel for the appellant, the appeal is dismissed as withdrawn
