02/29.09.2021. Heard Mr. Rahul Pandey, learned counsel for the petitioner and

Mr. V.S. Sahay, learned A.P.P. for the opposite party-State.

This criminal miscellaneous petition has been taken through Video

Conferencing in view of the guidelines of the High Court taking into account

the situation arising due to COVID-19 pandemic.

This petition has been filed for grant of special leave to appeal against

the judgment and order of acquittal dated 05.09.2018 passed by the

learned Judicial Magistrate, 1st Class, Jamshedpur in Complaint Case

No.2635/2014.

In view of the judgment dated 19.09.2018 passed by the Full Bench

of this Court in Cr. Appeal (SJ) No.1281 of 2016 along with analogous cases,

this petition is not maintainable.

Accordingly, this criminal miscellaneous petition stands dismissed with

the liberty to the petitioner, if so advised, to avail other remedy available

under the law. If any limitation arises, the pendency of this petition shall be

taken into account.
