06 / 27.09.2021 Heard learned counsel for the appellant Ms. Chandana Kumari and learned A.P.P Mr. Jitendra Pandey on the prayer for condonation of delay of 231 days in preferring the instant Memo of Appeal made through I.A. No. 5197/2021.

2. Learned counsel for the appellant submits that the appellant being poor could not prefer appeal within time. However, after arranging money, appeal has been preferred through his pairvikar. Appellant would suffer irreparably since he is suffering sentence for life under section 302 of the Indian Penal Code.

3. Learned A.P.P does not oppose the prayer.

4. Having considered the explanation and the submissions of the learned counsel for the parties, delay is condoned. I.A. stands disposed of.

5. Appellant stands convicted for the offence punishable under section 302 of the Indian Penal Code by the impugned judgment dated 23.01.2013 passed in Sessions Trial No. 280/2011 by the Court of learned Additional Sessions Judge-1, East Singhbhum, Jamshedpur and has been sentenced to undergo imprisonment for life by the impugned order of sentence dated 30.01.2013.

7. Call for the lower court records in connection with Sessions Trial No. 280/2011 from the Court of learned Additional Sessions Judge-1, East Singhbhum, Jamshedpur.

8. The prayer for suspension of sentence made through I.A. No. 5196/2021 shall be considered after receipt of the lower court records.
