08/20.09.2021 Learned counsel for the appellant husband in F.A. No. 110 of 2019 Mr. Rohit Agarwal submits that he would be entering appearance for the same party i.e., respondent husband in F.A. No. 117 of 2019.
Learned counsel for the respondent wife in F.A. No. 110 of 2019 and appellant in F.A. No 117 of 2019 Mr. Mukesh Kr. Dubey submit that parties may be referred for mediation to find out an amicable settlement of the matrimonial dispute.
Learned counsel for the husband also agrees to the proposal. The husband is posted in S.B.I. Mumbai presently. He would be in a position to attend the proceedings physically at JHALSA if convenient date is given.
Having regard to the intent shown on behalf of both the parties and that by the impugned judgment the marriage has been dissolved ex- parte with a decree of permanent alimony of Rs.25 Lakhs, the parties married in 2003 are living separately since 2009 and further two sons born out of the wedlock are staying with their mother, it would be proper if the parties venture to find out an amicable settlement of their matrimonial dispute at this appellate stage. Accordingly, let the parties appear physically before the Learned Member Secretary, JHALSA on
03.10.2021 at 10.30 a.m. On their appearance the matter be placed before the learned Mediator, JHALSA for undertaking the exercise. If need be, mediation may be continued on the successive date i.e., 04.10.2021 since the husband has to come from Mumbai and the wife also resides at Seraikella Kharsawan. Subsequent dates may be given as per their convenience. Option is left for the parties to attend the mediation on the subsequent dates online if travel restrictions are increased due to spike in covid cases in future. Husband shall pay a sum of Rs.1500/- as travelling and incidental expenses to the wife on each date she attends the mediation, in presence of the learned Mediator, JHALSA. Both the parties are expected to cooperate in the mediation process with open mind and attend each of the sittings. In case they are able to arrive at an amicable settlement of their dispute, the terms and conditions be reduced in writing under their joint signature and be submitted along with the report 6 weeks thereafter.
