4/13.09.2021 This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

Mr. Shailesh Kumar Sinha, the learned counsel appearing for the State seeks further four weeks' time for filing counter affidavit in terms of order dated 13.10.2020.

Time, as prayed for, is allowed.

I.A. No.4782 of 2021 has been filed for extension of interim order dated 13.10.2020.

Mr. Ajay Kumar Sah, the learned counsel appearing for the petitioner submits that in view of the judgment rendered in the case of "Asian Re-surfacing of Road Agency Pvt. Ltd. and Another v. Central Bureau of Investigation" reported in (2018) 16 SCC 299, it was necessitated to file this Interlocutory Application as the notice of proceeding in the matter has been received by the petitioner.

In view of the above fact and considering that the State is further seeking four weeks' time for filing counter affidavit and this matter is still pending in this Court, in the interest of justice, it is desirable that interim order dated 13.10.2020 is extended till the next date.

I.A. No.4782 of 2021 stands allowed and disposed of. Post this matter on 16.11.2021.

Since the interim order has been passed by this Court by order dated 13.10.2020 and it has been submitted today that now the case has been committed before the court of learned Additional Sessions Judge-IV, Bermo at Tenughat which is numbered as Sessions Trial No.135/2020, there shall be stay of further proceeding with regard to Sessions Trial No.135/2020 till the next date.
