CORAM: Hon'ble Mr. Justice Aparesh Kumar Singh Through: Video Conferencing

---

            For the Petitioner :
For the Opposite party-Bank : Mr. Rajesh Kumar, Advocate
                                                    ----
04/10.09.2021 Learned counsel for the opposite party-State Bank of India, Mr. Rajesh

Kumar submits on instructions that the instant petition has been rendered infructuous on account of subsequent developments during its pendency. It is submitted that after the order under offence was modified vide judgment passed in L.P.A. No. 108 of 2008, the petitioner preferred Special Leave Petition before Hon'ble Supreme Court being S.L.P. (Civil) No. 19404 of 2008, which was subsequently dismissed. Thereafter, the opposite party-officials of the Bank complied the order by passing a reasoned order which was made subject matter of W.P(S) No. 707 of 2017 filed by the petitioner herein. The writ petition was dismissed on 12th April, 2018 and thereafter Letters Patent Appeal no. 299 of 2018 has been filed by the petitioner, which is pending. As such, the original order under offence after modification in L.P.A has already been complied and nothing remains to be agitated.

In view of the categorical statements made by learned counsel for the Bank Mr. Rajesh Kumar, the instant contempt petition is disposed of.
