04/ 07.09.2021             Heard Santosh Kumar Soni, learned counsel appearing for the

petitioner and Mrs. Niki Sinha, learned counsel appearing for the State.

This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been heard.

After some arguments, learned counsel for the petitioner submits that in view of the judgment of the Full Bench in Criminal Appeal (SJ) No. 1281 of 2016 along analogous cases, he wants to withdraw this criminal miscellaneous petition with the liberty to avail the other recourse, if any, available in law.

Permission is accorded.

In view of such submission, this criminal miscellaneous petition is dismissed as withdrawn with the liberty to avail the other recourse in law, if available, and if question of limitation arises, the time spent in pursuing this case shall be accounted for, while counting the period of limitation, if any.
