04/06.09.2021          Learned counsel for the appellant submits that I.A.

No.2404/2021 has been filed in the present case for suspension of sentence. However, she submits that the case has not yet been admitted.

This Cr. Appeal has been filed against the judgment of conviction and order of sentence dated 20.03.2021 passed by learned Special Judge (POCSO), District East Singhbhum, Jamshedpur in Spl. POCSO Case No.29/2019 arising out of Galudih P.S. Case No.07 of 2019 .The appellant has been convicted for offences under Section 376DA and 120B of the Indian Penal Code and under Sections 4/6 of POCSO Act and sentenced to undergo imprisonment for life and fine of Rs.50,000/- for offence under Section 376 DA of the I.P.C. read with Section 6 of POCSO Act to be paid to the victim and in default of fine, to undergo further imprisonment of six months and also sentenced to undergo R.I. for 10 years and fine of Rs.5,000/- for offence under Section 120B of the I.P.C., in default of fine, to undergo further imprisonment for two months. Both the sentences have been directed to run concurrently.

Call for the lower court records from the court of learned Special Judge (POCSO), District East Singhbhum, Jamshedpur in connection with Spl POCSO Case No.29/2019.

I.A. No.2404/2021 will be considered after receipt of the lower court records. Let this order be communicated to the learned trial court.
