respondent-State is not satisfactory, inasmuch as, it has

not been stated as to why in view of the Full Bench

judgment passed in the case of Ram Prasad Singh and Anr.

with analogous cases, the claim of the petitioner has been

rejected.

Let a specific affidavit to be filed by the State to

the aforesaid effect before the next date of hearing.
