09 / 18.11.2021 Heard learned counsel for the appellant Mr. Anupam Anand and learned counsel for the Respondent Mr. Prabhat Kumar Sinha on the prayer for condonation of delay of 191 days in preferring the instant Memo of Appeal made through I.A. No. 1128/2021.

2. The appellant got decree of divorce in his favour, but is aggrieved by the permanent alimony of Rs. 5.00 lakhs granted in favour of the Respondent-wife by the judgment dated 21.06.2019 and decree dated 29.06.2019 passed in Original Suit No. 262/2016 by the Court of learned Principal Judge, Family Court, Bokaro.

3. It is submitted that the delay has occasioned due to the circumstances beyond the control of the appellant as he was held up in the treatment of his father.

4. Learned counsel for the Respondent has opposed the prayer.

5. However, on consideration of the grounds urged and submissions of the parties, delay is condoned. I.A. stands disposed of.

6. Learned counsel for the parties submit that both the parties may be referred to JHALSA to find out an amicable settlement of their matrimonial dispute.

7. Accordingly, let both the parties appear before the Member Secretary, JHALSA on 29.11.2021 at 10.30 am. Member Secretary, JHALSA can also be approached on the following phone numbers.

Matter be placed thereafter before the learned Mediator, JHALSA for undertaking the exercise. Parties are expected to cooperate in the mediation proceedings and attend each of the sittings. Appellant shall pay a sum of Rs. 1,000/- towards travelling and incidental expense to the Respondent on each

date she attends the mediation in the presence of learned Mediator, JHALSA. If they are able to arrive at an amicable settlement, terms and conditions thereof be reduced in writing under their joint signatures and be submitted along with the report four weeks thereafter.

8. Let the matter be listed in the second week of January 2022 along with the report.
