04/01.11.2021 In order to remove the surviving defect no.5(e) i.e. Vakalatnama appears to be scanned copy and not original, learned counsel for the appellant is allowed 4 weeks' time. Jail authorities are supposed to provide original copy of Vakalatnama since COVID restrictions have been substantially relaxed.

Sole appellant held guilty for the offences punishable under Section 302 of the I.P.C. vide impugned judgment dated 04.06.2021 passed in Sessions Trial Case No.230/2016 by the court of learned Additional Sessions Judge-VII, Jamshedpur has been sentenced to undergo rigorous imprisonment for life with a fine of Rs.10,000/- with a default sentence vide impugned order of sentence dated 07.06.2021.

Admit.

Call for the lower court records from the learned court of Additional Sessions Judge-VII, Jamshedpur in connection with Sessions Trial Case No.230/2016.

Prayer for suspension of sentence of the appellant made through I.A. No. 4520/2021 shall be considered after receipt of the lower court records.

It appears from perusal of paragraph-2 of the impugned judgment that while filing charge sheet bearing no.141/2016 dated 12 th April 2016 in connection with M.G.M. P.S. Case No.16/2016 against the accused/ appellant herein, investigation was kept pending against other accused persons.

Learned A.P.P. has to ascertain the status of the investigation as against the other accused persons, whether they have been charge sheeted ? If

so, what is the status of their trial ? Let an affidavit to that effect be filed within four weeks.
