06 / 01.11.2021 These two appellants who are husband and wife along with Mangal Yadav and Kali Yadav stand convicted for the offence punishable under sections 302/34 and 201/34 of the Indian Penal Code by the impugned judgment dated 17.01.2018 passed in Sessions Case No. 51/2016 by the Court of learned Additional Sessions Judge-IV, Deoghar and all the convicts have been sentenced to undergo R.I for life with a fine of Rs. 10,000/- each and default sentence each under section 302/34 of the Indian Penal Code and they have been further sentenced to undergo R.I for five years with a fine of Rs. 5,000/- each and default sentence each under section 201/34 of the Indian Penal Code by the impugned order of sentence dated 19.01.2018

2. Admit.

3. Call for the lower court records in connection with Sessions Case No. 51/2016 from the Court of learned Additional Sessions Judge-IV, Deoghar

4. The prayer for suspension of sentence made through I.A. No. 2382/2018 shall be considered after receipt of the lower court records.

5. Learned counsel for the appellants submits that other convict Kali Yadav has preferred Cr. Appeal (DB) No. 341/2018 which has already been admitted and lower court records have also been summoned. Office to verify whether lower court records have been received, if so, the same be placed along with the records of the instant case. Let records of appeal of other convicts be also placed when the matter is taken up.
