0/24.03.2021 Heard learned counsel for the parties on the prayer for condonation of delay of 41 days in preferring the instant memo of appeal made through I.A. No.3073/2020.
It appears that there is practically no delay in preferring the instant memo of appeal in view of the order dated 16 th December 2020 passed in F.A. No.49/2019 by this Court wherein it has been held that the limitation period in respect of appeals arising out of judgment and decree passed under the Hindu Marriage Act, 1955 shall be reckoned as 90 days in terms of Section 28(4) of the Hindu Marriage Act. Accordingly, I.A. No.3073/2020 is disposed of.
Learned counsel for the parties, upon instructions, submit that the parties are willing to engage in mediation process to find out an amicable settlement of their dispute at this appellate stage also.
Learned counsel for the appellant submits that since the appellant is residing at Muzaffarpur in Bihar, he may have difficulty in attending medication physically at JHALSA. Learned counsel for the respondent submits that the respondent being resident of Dhanbad, is ready to attend mediation physically at JHALSA.
Having regard to the aforesaid circumstances, let the parties approach the learned Member Secretary, JHALSA on 6th April 2021 between 10:00 A.M. to 1:30 P.M. for participating in a mediation exercise on the following phone numbers :-

On their approaching, matter be placed before the learned Mediator for undertaking the exercise. Depending upon the convenience of
the parties, mediation may be held physically or online or in a hybrid mode, as the case may be. In case the respondent participates in the mediation proceeding physically, appellant shall have to pay a sum of Rs.1,000/- to the respondent on each date, she attends mediation at JHALSA. Such payment can be made through digital mode in the bank account of the respondent.
Parties are expected to cooperate in the mediation proceedings and attend each of the sittings. If they are able to arrive at an amicable settlement, terms and conditions thereof be reduced in writing by the learned Mediator, JHALSA and be submitted along with the report four weeks thereafter.
Let the matter be listed in the week of 10th May 2021 along with the report.
